Vehicle Abatements
This message provides information on abandoned vehicles, including 72 hour parking violations, the abatement process and the recreational vehicle parking ordinance.
The California Vehicle Code and the Fremont Municipal Code authorize the towing of any vehicle parked or stored on any public roadway for more then 72 consecutive hours. 72 hours from the time of the issuance of a warning notice a vehicle will be subject to citation and/or will be removed and stored at the owner's expense. Incidental moving of the vehicle does not comply with the requirements of the ordinance. The vehicle must be driven a significant distance and the odometer reading must reflect this. If you have deferred your vehicle registration (referred to as "Plan Non-Op") your vehicle must be removed from the roadway. If your vehicle lacks an engine, transmission, tires/wheels, or any other part or equipment to operate safely on the highway it may be removed immediately, without warning, at the owner's expense.
If your vehicle and/or parts are parked on private property and is declared to be abandoned, wrecked, dismantled or inoperative it is in violation of the City of Fremont abatement ordinance. If your vehicle received a warning you need to comply with the law by taking one of the following actions within ten days of the date of the warning notice:
- Moving the vehicle to a licensed dismantler or wrecking yard.
- Completely enclosing the vehicle within a building, or
- Restoring the vehicle to normal operating service.
If you fail to comply with the initial warning, the full abatement processes will be initiated. This includes notification of the property and vehicle owners by certified letter advising of the violation. If you have received notice and you do not want the vehicle removed you have 10 days from the mailing of the notice to request a hearing in writing. If you request a hearing, you must either attend in person or present a sworn written statement with your reasons for denying responsibility. If the vehicle is removed under the abatement law, the vehicle will be marked for destruction and will not be returned to you. Subsequent administrative and removal costs of the vehicle and/or parts may be assessed against you.
If you wish to report an abandoned vehicle or you have further questions on this topic, Call the Abandoned Vehicle Hotline at 510/790-6775.
